Guidelines About Posting and Behavior

Introduction

The Guidelines About Posting and Behavior (hereinafter referred to as “these Guidelines”) are rules that must be observed when posting content. We request that all users read, understand and follow these Guidelines when using this service.

Posting Content

・Users must only post content that they own the copyrights and other such intellectual property rights to. Be sure to fully understand intellectual property rights before posting content.

・Set the appropriate ratings for posted content in accordance with the rating standards prescribed separately in Rating system & Guidelines (https://www.celsys.co.jp/en/information/rating/) and in accordance with other applicable ratings.

・Some content can only be posted to the service by users who have been approved through a separate screening system implemented by CELSYS. Please follow the instructions provided by CELSYS if separate approval procedures are necessary.

Prohibited Content

・Criminal content, or content that violates laws or public order and morality, or content that attempts to justify such acts.

・Content prescribed in the terms of service and policies as prohibited, including equivalent acts and expressions that encourage such acts.

・Portrayal of sexual organs, perverted sexual acts or simplified images thereof.

・Content related to child prostitution, child pornography or child abuse.

・Content that does not respect the freedom of religion, politics, race, beliefs, occupations and gender, or content which forces ideologies about or encourages conflict about such issues.

・Content that leads to other unrelated websites.

・Content that is generally considered unpleasant or disgusting by society.

・Content that is deemed inappropriate in light of the aims of the service.

Posted Content

・The copyright of posted content shall belong to the copyright owner who posted the content.

・CELSYS shall refuse permission to release or shall delete any content deemed to violate the terms of service and policies, or deemed by CELSYS to be inappropriate.

・Information may be formed within this service through links between the posting, response, correction and evaluation of content by multiple users. Examples include replies to questions, comments or reviews of content, and content created through collaboration between users. Therefore, the deletion or editing of certain parts of the content may alter the meaning or value of formed information, which may cause issues for certain users. Users who post content shall continue to hold the intellectual property rights to the posted content. However, CELSYS reserves the right not to provide functions such as deleting or editing, and to refuse requests for deletion or editing.

・CELSYS may process or replace data such as by duplicating, changing the size, localizing including translation, changing the capacity, changing the color gradient and changing the file name or file format (extension) of posted content within the required scope (assumed to be on list or details, notifications, recommendations, ranking pages, etc.) in order to provide this service to all users. However, CELSYS will not exceed this required scope.

User Responsibilities

・Users shall provide the sufficient amount of accurate information required for posting content.

・Users posting content may use the scope of services and functions provided by CELSYS to update, delete and otherwise manage posted content whenever necessary. Furthermore, users shall check that there are no problems such as mistakes, discrepancies or defects in the data, settings or submitted information of posted content. If a problem has occurred, the user shall change, correct, re-post or amend and supply information wherever necessary.

・Posting users are obligated to respond in good faith to inquiries, complaints and claims about the posted content.

Response to Reports

CELSYS shall respond as prescribed below in cases where the report of a violation is received.

・In cases where CELSYS deems the said content is inappropriate to be posted, CELSYS shall delete the said content. In this case, the poster shall be notified and warned of the deletion.

・In cases where CELSYS deems the said content is not inappropriate, CELSYS shall not delete the content.

・In cases where it is difficult for CELSYS to judge whether or not the content is problematic, the following steps shall be taken.

 (1) The poster shall be notified, and CELSYS shall wait for approximately 7 days for a response from the poster.

 (2) The appropriate steps shall be taken based on the response from the poster and in accordance with CELSYS’s judgment.

Guidelines About Posting and Behavior FAQ

Q. Content that is very similar to my own content has been posted. What should I do?

A. In cases where content posted to this service appears to infringe on your rights, CELSYS shall take the necessary steps in accordance with “Response to Reports”. Therefore, please contact our support team.

Q. What can I do to avoid violating the terms of use or guidelines?

A. CELSYS may implement measures such as deleting content or stopping accounts even if the posted content or actions are not prohibited under terms of use or policies if CELSYS deems it necessary to do so.

CELSYS requests that all users obey the terms of use and policies, as well as act morally in within the boundaries of general common sense to maintain a pleasant and stable service for all.

Q. Will CELSYS protect the copyright of my posted content for me?

A. In principle, CELSYS shall not intervene in any issues regarding copyright infringement. However, in cases where content posted to this service appears to infringe on your rights, CELSYS shall take the necessary steps in accordance with “Response to Reports”. In such cases, please contact our support team.

Q. Can I use material acquired through “CLIP STUDIO ASSETS” in work to be posted for commercial use or in fanzines?

A. Materials acquired through “CLIP STUDIO ASSETS” can in principle be used for both commercial and non-commercial purposes. However, some materials have special conditions similar to “Limited license materials”. For details, see the ASSETS Terms of Service and material information.

Q. Can I show work overseas that I created using material acquired from “CLIP STUDIO ASSETS”?

A. You can publically transmit, upload, distribute, transfer and lend any works created using such materials both domestically and overseas.

Q. Am I only allowed to post my own work? Or can I post the work of others if I get permission from the author? Is secondary use is OK providing the author has written “free for use”?

A. CELSYS believes that it very risky to post content for which the copyright belongs to a different individual user at this point in time, and therefore does not allow the posting of secondary use content on this service.

Furthermore, CELSYS does not permit users to allow their own copyrighted works to be used by others.

At present, the following risks must be considered in such cases.

・If the primary poster makes a mistake in notifying the scope of permission, there is a risk they will no longer be able to assert their rights in cases where their rights are infringed.

・If the secondary poster makes a mistake in understanding the scope of permission, there is a risk that the copyright owner may make a claim of copyright infringement against them.

・Risk that the user may receive a claim of copyright infringement.

However, if users of this service reach a mutual agreement to share secondarily created content, CELSYS believes this is a positive step in broadening the scope of creative activities.

CELSYS will continue to consider methods to avoid this type of risk.

Q. Can I add instructions such as “do not use this work” or “please show in this way” to material I have released through “CLIP STUDIO ASSETS”?

A. No, you cannot (excluding “Limited license material” posted by CELSYS). You need to consent to any type of use and work content for material released through “CLIP STUDIO ASSETS”. Use in works that infringe on copyrights or that violate laws or public morality is prohibited, but you cannot specify other usage methods or usage restrictions. Please make sure you understand these rules before releasing material.

Q. Can I add instructions such as “please add my name so that it is clear you are using my material” to material I have released through “CLIP STUDIO ASSETS”?

A. No, you cannot (excluding “Limited license material” posted by CELSYS). No, you cannot specify that the author’s name be displayed for materials released through “CLIP STUDIO ASSETS” because there are cases where the author’s name cannot be displayed due to the characteristics of the material, or purpose and conditions of use. Please make sure you understand that names (pen names), etc. cannot be displayed before releasing material.

Q. Can I add instructions such as “do not process, modify or change this material” to material I have released through “CLIP STUDIO ASSETS”?

A. No, you cannot (excluding “Limited license material” posted by CELSYS). No, you cannot prohibit such actions as it is assumed that materials released through “CLIP STUDIO ASSETS” will be processed, modified or otherwise changed for use. Please make sure you understand that material will be processed, modified or changed for use before releasing material.

Q. I want to delete my posting but I cannot find the delete feature in this service. Can I request for it to be deleted?

A. A delete feature is not provided on this service for posted material, so in principle material cannot be deleted or edited. For details, please also see each of the terms of service. Please contact our support team if you have mistakenly posted inappropriate content, or if you find other posted content that appears to be inappropriate. CELSYS shall judge whether or not the content should be deleted.

Q. I have found a user who is causing problems, what should I do?

A. Cautioning or advising other users directly may have the unwanted consequence of be seen as an attempt to disregard the rights of other users or may be taken as a threat by the said user. Therefore, if you are concerned about the actions of other users, please use the report function or contact our support team. CELSYS will take the appropriate action based on our own judgment of the situation.
